Han Li is an associate at Llinks Law Offices in Shenzhen, a leading PRC law firm. Mr. Li graduated from prestigious law schools both in China and abroad and offers creative thinking benefiting from common law knowledge in resolving novel legal issues. He specializes in cross-border dispute resolution, including disputes involving investment and finance, international sale of goods, joint venture, intellectual property, and arbitration-related proceedings including determination of validity of arbitration agreements, recognition and enforcement of arbitral awards, cross-border taking of evidence and emergency arbitration.
Mr. Li has represented as counsel before major arbitral institutions including HKIAC, ICC, SCC, CIETAC and secured victories in the clients’ favour. He has served clients across various industries, including finance, manufacture, medicine, construction, energy and gaming. His high profile cases include many of the landmark cases contributing to the judicial practice in China, including:
Representing three US investors in the medical sector in a CIETAC arbitration; it was the first case where injunctive relief in arbitration was ever granted (see Supreme Court Report on China Arbitration Judicial Review 2019), and the first case where the US court granted the taking of evidence under the U.S.C. Section 1782 in aid of China-seated arbitration.
Acting for a Swedish company in the recognition and enforcement of a Swedish ad hoc arbitral award in China. It was the first case where the Chinese court addressed procedural irregularity issues in expedited arbitrations, and was selected by the Supreme Court as a guiding case in 2022)
Mr. Li is listed in the talent pool of lawyers in Shenzhen who are well versed in foreign-related matters. He authored the book chapter Navigating Conflict of Laws in International Commercial Arbitration in China in Dispute Resolution in China, Europe and World (Springer, 2020). He was also a regional rapporteur for the international project ICCA-IBA Joint Task Force on Data Protection in International Arbitration, and provides assistance to Kluwer Arbitration-Arbitrator Intelligence, a major international legal publisher.
